Legal Responsibility in BDSM – Injuries

I’ve been reading a great conversation on Fetlife regarding the legal responsibility of a Dom for injuries incurred by a sub during a Scene.

It’s a great question and an unfortunate possibility anyone in this Lifestyle needs to consider and (at the very least) think about.

If you knowingly engage in an activity with significant risk, safety precautions are taken and followed, and injuries result (not due to negligence)…where does responsibility lie?

No, this story has nothing to do with me. I’ve been quite fortunate thus far!

Consensual? Yes. Safe or Sane? Hell no!

Passed Out and Twitching is NEVER Good.

Those were my thoughts as they gathered around her. Her Dom stood watching (seemingly on the verge of panic). Her convulsions subsided and she slowly began to respond. He looked at the group watching the Scene, held out his hand and declared:

“I assure you, she’s alright. Everything’s alright!”

What they’d done was this:

2 Doms wrapped a few nice coils around her neck, set a proper release rope and hoisted her to the very tips of her toes until she passed out. (That is after the assisting Dom reminded the Dom to center his sub under the hoist so she wouldn’t swing…a big problem).

It took a good few minutes for the sub to completely recover…before the did it again, to her.

Did this scene look cool. Yes.

Did this scene show an incredible amount of trust. Yes.

Was this scene a bad idea in a mixed group of experienced and inexperienced Lifestylers? YES!
